Jefferson County's headline-grabbing bankruptcy comes as the number of Alabamians going belly-up, financially speaking, is on the decline.
The number of personal bankruptcies in the state has dropped for four straight quarters, according to the latest figures from the American Bankruptcy Institute , an Alexandria, Va.-based research firm.
In the second quarter of this year, the latest period for which there is data, there were 7,417 personal and business-related bankruptcies filed in Alabama. The number of Alabama filings has been falling ever since hitting a combined total of 8,687 in the second quarter of 2010.
Bankruptcy filings in the state are down significantly since hitting a record 9,104 in the third quarter of 2009, during the height of the recession, according to American Bankruptcy Institute figures.
Alabama has joined a national trend, in which U.S. personal bankruptcy filings totaled 106,255 during October, down nearly 20 percent from a year earlier, according to the American Bankruptcy Institute's analysis of data from the National Bankruptcy Research Center.
"The declining filings correlate to tightened consumer spending and the overall pull back in consumer credit associated with a stagnant economy," American Bankruptcy Institute Executive Director Samuel J. Gerdano said in a statement. "We expect total 2011 consumer filings to be less than 2010."
Brad Botes, a partner in the Birmingham-based Bond and Botes law firm, which represents bankruptcy clients across the Southeast, said he is not surprised that the number of filings are on the decline from the height of the economic downturn two years ago.
"The numbers reflect a sense of hopelessness," Botes said. "Bankruptcies are down significantly from last year. I think that shows that a lot of people suffering in this economy have given up and feel there is no way out so why file."
Botes, however, said he believes bankruptcy filings could soon begin to rise as the state and national economies remain sluggish, with Alabama's jobless rate remaining near double digits (9.8 percent in September). The metro Birmingham unemployment rate was 8.9 percent in September.

We've heard from clients who spent thousands of dollars on those debt companies and gotten ripped off by pay-day loan and cash advance companies that prey on the poor." Botes said he believes last week's Chapter 9 filing by Jefferson County,

I’d be the first to admit that I have not always been the greatest with money. Sure, I got that credit card when I was a freshman in college and ran it right up to that limit. And then got five more. But a girl needs to treat herself once in awhile and the ramen noodle lifestyle was really not working for me.
I have grown since those days. I got my degree and I’ve been working out in Nevada for nearly five years now. I paid off those cards and said goodbye to debt. I may have lived the high life during the college years, but I did find myself with a cup of ramen noodle soup on a Saturday night more than a few times while trying to pay those little demons off. But I was free at last. And I was planning on giving my budget a wee bit of breathing room and implementing an appropriate savings plan.
And that is when it hit the fan, so to speak. My car broke down-I have no clue what was really wrong with it, but the bill was more than I had at the moment. Like I said, I had made the final payment on the last credit card, knowing that I really didn’t need much cash until the next payday in a little over a week. Compounding the problem was the fact that I would really need two paychecks to cover the cost and my living expenses. That was nearly a month away-no way I could go without my car for that long.
The repair guy suggested looking into Nevada payday loans. Oh, sure, that’s what I wanted to do-go right back into the debt spiral. I took the bus and walked a mile home, feeling pretty sorry for myself. I called my best friend, who unfortunately lives in Utah now. Of course, she let me vent and cry. Then she told me about how she had to get a Utah cash advance in a similar situation a few months ago and how well it worked out for her. She told me that the trick is to choose a good company and pay that sucker off ASAP.
So, feeling a little better (that’s what besties do, right? Make us feel better?) I got online and checked out the company she has used for the Utah cash advance. I was in luck-they also had locations for Nevada payday loans. I actually checked out the rates and applied right there. I got approved and the money was in my account the next day. I called Mr. Repairman and he got to work.
