The current firestorm over banks’ earnings and a decision to charge fees to use debit cards overshadows the bigger issue: we won’t have transparent, competitive markets for debit cards and other financial products until we have basic standards of fairness and a sheriff on the beat to enforce them. Congress should let the new Consumer Financial Protection Bureau do this job.

Civil rights and consumer groups have long been concerned about the cost, fairness and accessibility of financial services. Indeed, the economic crisis hurting all Americans was caused by unsustainable mortgages with purposely hidden risks and costs. Fair and sustainable financial products are good for consumers, taxpayers and the overall economy, and even for the banks and their shareholders in the long term.

Effective financial oversight makes pricing more transparent, so banks compete with cheaper products and customers can shop for the best offer. Today, debit card markets operate as credit cards did a few years ago. Credit card companies offered customers misleadingly low rates, then used deceptive practices and hidden fees to make actual costs much higher. The 2009 Credit Card reform act prohibited tricks and traps like exorbitant late fees, deceptive payment allocations and arbitrary interest-rate hikes on existing balances.

Debit card markets, by contrast, remain unfair and dysfunctional. Take overdraft fees: many banks charge $35 for each small debit card purchase that exceeds an account balance. Some banks even reorder consumer transactions when processing charges, paying large purchases first to artificially increase the number of overdraft charges. A few major banks even add payday loans to accounts, with 350 percent interest rates.

These fees go far beyond covering the cost of providing checking accounts and debit cards, and inflate earnings. One banker declared overdraft fees so lucrative that “If I had two more products like …. [this], I could quit making loans altogether.” These fees pull billions of dollars annually from consumers’ pockets; one overdraft a month would add up to $420 a year in fees.
